Preamble
By validating their order, the Customer declares that they unconditionally accept the terms of said order as well as the entirety of these General Terms and Conditions of Sale.
Purpose of the Service
ShiftCab is a transportation service (hereinafter “the Service”) that allows you to immediately or later book an economy or premium car with a private driver via our website
www.shiftcab.fr, our mobile site, or by calling +33189701970. Trips are made without intermediate stops from a departure address A to a destination address B, except for the “At Your Disposal” service, for which only the departure address is required.
Access to the Service
The Customer who wishes to use the Service can book a vehicle by phone at 01.80.90.65.67 or via the website
www.shiftcab.fr 24/7 by providing their name, departure address, destination, phone number, and optionally their email.
Rates and Payment Methods
The rates for accessing the ShiftCab service are specified in the online booking form. The current rates are available at all times on the website
www.shiftcab.fr.
Any transportation service must be paid in full upon completion, except for customers subscribed to the Service. Payment is to be made to the driver. For companies holding an account or subscription, invoices are payable upon receipt by check, bank transfer, or credit card. Any invoice not paid within 30 days of receipt will automatically incur penalties equal to one and a half times the legal interest rate.
Tolls, parking fees, and meals are the responsibility of the transported persons.
Luggage is accepted within the loading capacity of the vehicle’s trunk and remains under the Customer’s responsibility.
Accepted Payment Methods
Cash, credit cards (Visa, MasterCard, etc.). Any transportation service must be paid in full upon completion.
Any complaint is only admissible within 7 days of the execution of the transportation service in question. Any dispute falls under the jurisdiction of the courts at the location of ShiftCab’s head office, the owner of the ShiftCab service.
Services and Liability of ShiftCab
ShiftCab undertakes to do everything necessary to transport the passenger to their destination as quickly as possible and under optimal safety conditions. In this regard, the driving and custody of the vehicle belong to ShiftCab, which complies with the Highway Code.
ShiftCab is insured by a reputable insurance company that covers the risks related to its activity in accordance with current legislation.
Passengers, as third parties with respect to the driver, are covered for bodily, material, and immaterial damages they may suffer as a result of a traffic accident, from boarding to alighting, except for damages caused by their own fault.
For safety reasons, smoking or transporting flammable, explosive, corrosive, or toxic substances is prohibited. Non-compliance with this stipulation engages the liability of the Customer and the passenger. ShiftCab reserves the right to take any necessary legal action.
Animals are not allowed for transport unless a specific arrangement is made; in any case, ShiftCab cannot be held liable for this.
It is expressly agreed that delays in transportation due to unforeseen traffic difficulties (traffic jams, accidents, detours, weather conditions, various events, etc.) do not entitle the Customer to any compensation.
In the event of damage to the equipment or vehicle caused by the passenger, any restoration or replacement of the material, regardless of the cause, will be invoiced to the Customer. Any damage caused to a third party as a result of the passenger’s non-compliance with basic safety rules will be the responsibility of the Customer.
ShiftCab reserves the right to disembark a passenger from the vehicle if they do not comply with the safety instructions provided by ShiftCab, without the possibility of demanding a refund for the trip.
A vehicle breakdown that is not due to poor maintenance and that occurs while picking up the Customer or during the trip with the Customer cannot, in any case, give rise to compensation.
Any complaint must be made within 48 hours after the trip, by registered letter with acknowledgment of receipt.
Billing for Waiting Time
One hour of waiting is offered after the flight lands. Beyond that, each additional hour of waiting is billed in full.
For a round trip, the time interval between the arrival time at the destination for the outbound trip and the return time must be at least 1 hour and 30 minutes. If the time interval is less than 1 hour and 30 minutes, the driver is required to wait, and the waiting time is billed as indicated in the previous paragraph.
Jurisdiction
These General Terms and Conditions of Sale are governed by French law. In the event of disputes relating to the execution or interpretation of these terms, and if the Customer is a merchant, jurisdiction is attributed to the Commercial Court of Pontoise.

For any information, questions, or complaints, the customer can contact the Customer Relations department of the company from Monday to Friday, 9 a.m. to 6 p.m.

Internet Usage Rules
The Customer declares that they accept the characteristics and limitations of the Internet and, in particular, acknowledge that:
- The Customer is solely responsible for the use they make of the information. Consequently, ShiftCab cannot be held liable, whether expressly or implicitly, for any direct or indirect damages resulting from the use of said information;
- They are aware of the nature of the Internet, particularly its technical performance and response times for consulting, querying, or transferring information;
- The communication by the Customer of their personal identification details or, in general, any information deemed confidential by the Customer is done under their own responsibility;
- It is the Customer’s responsibility to take all necessary measures to ensure that the technical characteristics of their computer allow them to consult the information;
- It is the Customer’s responsibility to take all appropriate measures to protect their own data and/or software from contamination by any viruses that may circulate through the site.
Applicable Law and Competent Jurisdictions
This contract is governed by French law. In the event of a dispute concerning the application or interpretation of this contract, the parties agree to seek an amicable solution. Failing that, all disputes to which this contract may give rise, concerning its validity, interpretation, execution, termination, consequences, and follow-up will be submitted to the court of Cergy-Pontoise.
Customer Acceptance
These General Terms and Conditions of Sale are expressly agreed to and accepted by the Customer, who declares and acknowledges having full knowledge of them and, as a result, waives the right to invoke any contradictory document, and in particular their own general purchasing conditions, which will be unenforceable against the Service Provider, even if they have been brought to their attention.
